EIGHTH CIRCUIT AFFIRMS DISMISSAL OF LAWSUIT AGAINST FIRM’S CLIENTS IN DISPUTE OVER 9,000 ACRES OF LAND

Plaintiffs sought an interest in over 9,000 acres of land in South Dakota owned by GRBB’s client. In 2022, GRBB successfully argued that Plaintiffs failed to show they suffered an injury in fact and therefore lacked standing.

Following the district court’s dismissal, however, Plaintiffs filed an appeal before the Eighth Circuit. Once again, GRBB’s client prevailed, as the Eighth Circuit agreed with the arguments advanced by John Bowerbank and Hugo Lopez and held the district court properly dismissed the lawsuit for lack of standing on January 10, 2023.

The Firms’ clients are ecstatic with the ruling and have filed a motion to recover all attorney’s fees and costs from the Plaintiffs.
